Terms & Conditions

1. Introduction

These Terms and Conditions govern your access to and use of the Genesis Genetics application and associated services (the "Platform"). By registering, posting an advertisement, or using any feature, you agree to be bound by these Terms.

2. Platform Role and Limitations

• • The Platform is an advertising service only. We provide a venue for users to list genetics for sale.
• • We are not a party to any transactions between buyers and sellers. All negotiations, payments, delivery, and disputes regarding genetics occur directly between users.
• • We do not verify, endorse, or guarantee the accuracy, legality, safety, or quality of any listings, genetics, or user representations.
• • Users are solely responsible for complying with all applicable laws, including biosecurity, gene technology, and consumer protection requirements.

3. User Accounts and Conduct

• • You must provide accurate information during registration.
• • You agree not to post listings that are illegal, misleading, or infringe third-party rights.
• • Prohibited content includes human genetic material unless expressly permitted, or any content violating therapeutic goods advertising rules.

4. Advertisements and Subscription Payments

• • Advertisements are available as basic or premium options, payable via Stripe as a one-time fee.
• • Each advertisement is active for 28 days from payment confirmation. After expiry, it is automatically removed unless renewed by a new payment.
• • Payments are non-recurring; there are no automatic renewals unless you initiate a new payment.
• • All fees are in AUD (or as displayed) and include any applicable GST.

5. Payment Terms

• • Payments are processed securely via Stripe. By paying, you authorise Stripe to charge your selected payment method.
• • Fees are non-refundable except as required by law (see Section 7).
• • You are responsible for any transaction fees imposed by your financial institution.

6. Cancellation and Expiry

• • Advertisements cannot be cancelled mid-term for a refund, as the service is provided immediately upon payment and listing activation.
• • You may remove your advertisement at any time, but no refund will be issued for the unused portion of the 28-day period.

7. Refund Policy

• • Refunds are not provided for change of mind or voluntary non-use.
• • In accordance with the Australian Consumer Law, you are entitled to a remedy (including refund) if the service fails to meet consumer guarantees (e.g., not provided with due care and skill, or not fit for the advertised purpose).
• • To request a remedy, contact us with details of the issue. We will assess and respond within a reasonable time.
• • Stripe charges are generally non-refundable by us once processed; any approved refund will be issued to your original payment method where possible.

8. Liability and Disclaimers

• • The Platform is provided "as is." We disclaim all warranties to the extent permitted by law.
• • Our liability is limited to resupplying the service or refunding the fee paid, except where prohibited.
• • We are not liable for losses arising from user transactions, disputes, or illegal activities.

9. Termination

We may suspend or terminate access for breach of these Terms.

10. Governing Law

These Terms are governed by the laws of Queensland, Australia.
